Is this child abuse?

Since Gabe refuses to come in to sit on the potty in the house, and rarely is wearing clothes outside these days, I thought that I'd bring the potty to him. Unfortunately, peeing in the grass is way more fun than actually going in the potty, so it still remains unused (I doubt that Babies R Us would take it back, though). Perhaps when winter comes again, I'll have to get a potted plant or something.
